As observed in the order dated 26.08.2025, despite service, none had made appearance on behalf of the respondent. Even, today none has made appearance on behalf of the respondent. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-248-2025, titled 'Dilpreet Singh vs. Kulwinder Kaur', which is pending in the Family Court (Camp Court), Batala and she seeks transfer of the same to the Court of competent jurisdiction at Amritsar.

TA-769-2025 -2It is submitted by learned counsel for the applicant that marriage between the parties had taken place on 24.04.2023 and one son born, who is aged about 11⁄2 years, is in the care and custody of the applicant. On account of matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning and as such, she has filed petition under Section 125 Cr.P.C. as well as petition under Section 12 of the Protection of Women from Domestic Violence Act. Both the aforesaid cases are pending in the Courts at Amritsar and the same are at appearance stage. The respondent is stated to be employed as Deputy Manager in a bank at Batala.

In view of the aforesaid circumstances, it is pertinent to mention that the respondent, as such, has not come forward to resist the transfer application. The applicant herself has no source of earning and even then, she is taking care of the minor son, born from the said wedlock. Also, two other litigation, arising from the matrimonial dispute, are pending in the Courts at Amritsar.

In view of the aforesaid mitigating circumstances, the transfer application is hereby allowed and the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-248-2025, titled 'Dilpreet Singh vs. Kulwinder Kaur', stands transferred from the Family Court (Camp Court), Batala, to the Court of competent jurisdiction at Amritsar. The requisite record of the aforesaid case be sent by the Family Court (Camp Court), Batala, to the District and Sessions Judge, Amritsar. Learned District and Sessions Judge, Amritsar, shall assign the

TA-769-2025 -3said petition to the Family Court, Amritsar. Even, the parties are directed to appear before the Family Court, Amritsar, within a period of one month from today onwards.
