Prayer in this writ petition is for direction to the respondents to release benefits due to the petitioners including amount under Group Insurance Scheme and interest on delayed payment.

It is contended that pay equivalent to an employee junior to the petitioner was denied to her on the ground that certain other benefits were granted which disentitled her for the same pay. Said benefits were withdrawn in the year 2013 after her retirement on 31.10.2012. Reference is made to Annexure P15. Petitioner represented to the authorities against this action and ultimately served legal notice dated 09.07.2015, Annexure P10. CWP No.23430 of 2015 [2] benefits i.e., amount of Group Insurance Scheme (GIS) as well as interest on the delayed payment has also been claimed in the legal notice. However, no action has been taken by the respondents thereon. It is prayed that respondent No.2 be directed to decide the legal notice served upon the respondents in a time bound manner and release the benefits due to the petitioner. Keeping in view the limited prayer, the facts and circumstances of the case but without expressing any opinion on the merits of the controversy, this writ petition is disposed of with a direction to respondent No.2 to expeditiously decide legal notice dated 09.07.2015 Annexures P10, by passing a speaking order, preferably within a period of four months from the date of receipt of a certified copy of this order. In case, any amount is found due towards the petitioner, same be released within a period of six weeks thereafter. ( LISA GILL ) November 3 , 2015.
