In this writ petition filed under Articles 226 and 227 of the Constitution of India, the petitioners have prayed for issuance of a writ in the nature of mandamus for directing respondents No.1 and 2 to require and obligate them to act in accordance with terms and conditions of contract under which the apartments where offered and accepted by the petitioners and not to deviate from their statutory obligations under provisions of Punjab Apartments Ownership Act pertaining to election of the Cooperative Society for implementing the contractually binding participative mode of management of affairs of society, especially management of maintenance fund and corpus fund established with sole contributions of the residents including the petitioners.

After arguing for sometime, learned counsel for the petitioners submitted that he may be permitted to withdraw the present writ petition with liberty to the petitioners to approach respondent No.1 at the first instance.
