The petitioner in the instant writ petition has challenged the acquisition proceedings initiated pursuant to notifications under Sections 4 & 6 of Land Acquisition Act, 1894 mainly on grounds of provisions of Section 24(2) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act). 2.

Since the Law pertaining to Section 24(2) of RFCTLARR Act stands finally settled by a Judgment of Constitutional Bench of Hon'ble the Apex Court rendered in Indore Development Authority v. Manoharlal and Others (2020) 8 SCC, learned counsel for the petitioner submitted that his primary ground for assailing the acquisition proceedings in the present case being based on provisions of Section 24(2) of RFCTLARR Act, the instant petition would not survive, but since there are other issues as well though not part of the PANKAJ KAKKAR 2026.02.25 16:28 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court at Chandigarh

CWP-2423-2014 (O&M) ( 2 ) present writ petition, he may be permitted to withdraw the instant writ petition with liberty to file afresh so as to challenge the acquisition proceedings on all other grounds as may be available to him as and when required.

In view of the aforesaid submission, the instant petition is dismissed as withdrawn with liberty aforesaid.
