(Oral) Petitioner is seeking issuance of direction to the respondents to consider his candidature under handicap category for the post of Assistant Engineer (MECH) advertised, vide advertisement dated 10.07.2017 (P-2). On notice of this petition, a written statement has been filed in the Court today and the same is taken on record. As per written statement, no post has been reserved for candidate suffering from any other disability except for hearing impairment. As per certificate issued to the petitioner (P-1), he is suffering from congenital deformity cervical spine and thus, he is not eligible under handicap category.
If the petitioner had any grievance, he can challenge the advertisement and now after he chose to sit in the exam under General category and result has not gone in his favour, he has approached this Court to consider his candidature under handicap category. Thus, the petitioner is estopped by his own conduct from claiming his candidature under reserved Gaurav Arora 2019.05.

In view of the reply filed by the Commission, at this stage, no ground is made out for issuance of direction to the respondents to consider his candidature under handicap category for the post of Assistant Engineer (MECH) The writ petition stands dismissed.
