Counsel for the petitioner submits that the grievance of the petitioner is that out of two bank guarantees furnished for completion of the work for respondent No.1, second bank guarantee amounting to Rs.5.00 lacs is still lying with the respondents and is not being permitted to be encashed without any reason.
Counsel for the petitioner submits that the petitioner will be satisfied, at this stage, in case a direction is issued to respondent No.1 to consider the request of the petitioner (Annexure P-11), which was received in the office on 4.11.2016.

Without expression of any opinion on merits of the case, this petition is disposed of at this stage with a direction to respondent No.1 that the claim of the petitioner for release of second bank guarantee for a sum of Rs.5.00 lacs along with the earnest money would be finally decided by respondent No.1 within a period of two months after the receipt of a certified copy of this order. It will be the responsibility of the petitioner to communicate the order to the concerned authority.
