***** HARSH BUNGER J. (ORAL) The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondent No.2 to re-issue the passport to the petitioner.

Short reply dated 24.07.2025 on behalf of respondents No.1 and 2 has been filed, which is already on record, wherein the following stand has been taken:

That the petitioner had applied for issuance of passport vide file No. JA3079519433224 dated 25.04.2024 and the case of HIMANI GUPTA 2025.08.13 13:46 I attest to the accuracy and integrity of this document

the petitioner was processed subject to pre-police verification report, but the police authority marked his report as 'Adverse' with the remarks that "FIR NO 54 DATED L9-04-20L2 U/S 324, 323, 427, 148, 149 IPC at PS SIIAHKOT".

That on 20.06.2024, a letter seeking clarification was issued to the petitioner, but the petitioner did not responded to the letter dated 20.06.2024. A copy of letter dt.20.06.2024 is enclosed as Annexure R-I. That case of the petitioner was closed on 16.05.2025 vide letter dt. 16.05.2025 at Annexure R-II. 5.

That it is pertinent to mention here that presently there is no file application pending with the office of the respondent i,e. RPO, Jalandhar in respect of the petitioner." 3.

In view the stand taken by respondents No.1 and 2, learned counsel for the petitioner submits that he may be permitted to withdraw the instant writ petition at this stage, with liberty to the petitioner to apply afresh for issuance of passport along with necessary documents/information. 4.

Keeping in view the above, the present petition is disposed of accordingly.

4.1 It goes without saying that in case the petitioner applies afresh for issuance of passport supported by relevant documents/information, the said application be considered in accordance with law and final order be passed within a period of eight weeks from the date when such application is submitted by the petitioner.
