Prayer in this petition is for grant of interim bail to the petitioner in case arising out of FIR No. 329 dated 14.11.2025, registered under Section 21 of the NDPS Act, 1985 (Sections 20, 22 and 29 of the NDPS Act and Sections 25 and 27 of the Arms Act added later on) at Police Station Rama Mandi, District Jalandhar.

Learned counsel for the petitioner submits that the petitioner has been arraigned as an accused in the aforesaid case and is lodged in District Jail, Kapurthala since long. Though the present petition was filed for grant of interim bail to the petitioner as his wife was at the advance stage of pregnancy, however, during the pendency of the petition, she has delivered a baby on 12.06.2026. Due to medical complications, she is not maintaining good health after the delivery of the baby. CRM-M-30352-2026 (O&M) -2not possible if the petitioner is not released from custody. Hence, it is urged that the petitioner may be granted concession of interim bail for a period of two months for the said purpose.

Learned State counsel, on the basis of the instructions received from the SHO of the Police Station concerned, has not disputed the aforesaid fact but has expressed apprehension of the petitioner's absconding or committing similar offences, if extended benefit of interim bail. 4.

This Court has heard the rival submissions.

Since the wife of the petitioner has recently delivered a baby and they (the mother and baby) need proper medical as well as personal care, this Court finds it appropriate to release the petitioner on interim bail so that he can take care of them. Accordingly, the present petition is disposed of. The petitioner is ordered to be released from custody on interim bail w.e.f. 03.07.2026 till 03.08.2026, subject to his furnishing personal bonds as well as surety bonds by two sureties to the satisfaction of the trial Court/Duty Magistrate concerned. He is directed to surrender before the jail authorities on 04.08.2026 by 05:00 PM, without fail.
