-.- AMIT RAWAL J. (ORAL) Prayer in present application is to dispose of writ petition, though the main case is listed for 26.08.2019, in view of the fact that petitioner sought two-fold relief; one is for quashing of order dated 14/27.12.2017 (Annexure P-7) awarding punishment of stoppage of two annual increments without cumulative effect and order dated 18.06.2018 (Annexure P-9) whereby representation of petitioner has been rejected.

Mr. Malik, learned senior counsel assisted by Mr. Sandeep Dhull, learned counsel appearing for the petitioner submitted that during pendency of writ petition, respondents have withdrawn the punishment order and petitioner has been exonerated vide 7/12.6.2019 (Annexure P-18) and therefore, only cause which survives is consideration of his case for promotion, which is also second relief sought in the writ petition.

Keeping in view these circumstances, application is allowed and I deem it appropriate to dispose of writ petition with direction to respondents to consider case of petitioner for promotion as Deputy District Education Officer with effect from the date his juniors have been promoted within a period of three months from the date of passing of this order, failing which respondents shall be liable to costs of `50,000/- to be paid to the petitioner from salary of concerned officer, who has to decide the representation.
