By way of second petition filed under Section 482 Cr.P.C., prayer has been made for issuance of a direction to respondent No.3 to look into the representation submitted by the petitioner in a fair and impartial manner while conducting the investigation in FIR No.205 dated 17.08.2020 registered under Sections 323, 324, 452, 307, 379-B, 427, 506, 148 and 149 IPC at Police Station Tanda District Hoshiarpur.

On 02.04.2024, following order was passed by this Court:- "In the present case, a status report dated 12.01.2021 was filed before this Court on behalf of respondents under the signatures of Daljit Singh, PPS, Deputy Superintendent of Police, Sub Division Tanda, District Hoshiarpur wherein, it was stated that in terms of the cross-version put forth by the petitioner, DDR No.32 dated 03.12.2020 was recorded, however, learned counsel for the petitioner points out that at the time of filing of final report a cancellation report was submitted in terms of the aforementioned DDR and even despite there being a specific order dated 06.01.2023 passed by Judicial Magistrate First Class, Dasua regarding non-acceptance of the said cancellation report as regards the DDR and MOHMED ATIK 2024.04.04 17:58 I attest to the accuracy and authenticity of this order/judgment

CRM-M No.34952 of 2020 2024:PHHC:045775 direction for further investigation, no further report has been submitted by the Investigating Agency before the Court concerned. Keeping in view the aforesaid conduct of the Investigating Agency, this Court is compelled to request respondent No.2 i.e. Superintendent of Police, District Hoshiarpur to come present and apprise this Court about the steps taken in furtherance of the status report dated 12.01.2021 as well as the order dated 06.01.2023 passed by learned Judicial Magistrate First Class, Dasua.

It may be pointed here that the aforesaid conduct of the Investigating Agency forced the petitioner to file a complaint as regards the allegations which formed part of DDR No.32 dated 03.12.2020 wherein private respondents have even been summoned.

Adjourned to 04.04.2024."

Today, Mr. Surinder Lamba, IPS, Sr. Superintendent of Police, District Hoshiapur is present in Court and informs that further investigation regarding the allegations forming part of DDR No.32 dated 03.12.2020 is being got done through some senior police officer and final report shall be presented in the Court concerned within a period three weeks from today. [4].

In view of aforesaid stand taken by the officer concerned, the present petition is disposed of.
