The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing respondents No.2 and 3 to appoint the petitioner as Soil Conservation Officer in the respondent-department being 1st in the merit against the vacancy which has occurred before the date of appointment due to the non-acceptance of the said post by two selected candidates, with all back/consequential benefits. The petitioner has also prayed for issuance of directions to the respondents to decide his representations dated 11.01.2013 and 11.09.2013 (Annexures P-6 and P-8 respectively).

There is no representation on behalf of the petitioner for the last two consecutive dates of hearing. Even today also, the position is the same. It appears that the petitioner is not interested to pursue the present writ petition.
