Prayer in the present petition is for transfer of petition filed under Section 13 of the Hindu Marriage Act, 1955, bearing DMC No. 53 of 2020, titled as, "Harpreet Singh v. Sandeep Kaur" pending in the court of Additional District & Sessions Judge-2, Fatehgarh Sahib, to any court of competent jurisdiction at District Rupnagar.

It has been inter alia contended that since the applicant is a lady having a minor son, it will not be possible for her to attend the proceedings in the petition under Section 13 of the Hindu Marriage Act, filed by the respondent-husband at Fatehgarh Sahib. It has also been contended that since the applicant has filed a petition under Section 125 Cr.P.C. at Rupnagar, it will be convenient for her to attend the proceedings in both the cases at Rupnagar, as she is a resident of Village Kainaur, which is in District Rupnagar.

TA-487-2020 - 2 - No ground is made out for transfer of the aforesaid petition from Fatehgarh Sahib to Rupnagar. The petition under Section 13 of the Hindu Marriage Act, was filed by the respondent-husband prior in time on 09.04.2020, to the the petition under Section 125 Cr.P.C. filed by the applicant-wife on 31.08.2020. Moreover, Fatehgarh Sahib and Rupnagar are adjoining districts and in close vicinity to each other. Hence, it would not cause any inconvenience to the applicant-wife to attend the proceedings in the petition under Section 13 of the Hindu Marriage Act, filed by the respondent-husband at Fatehgarh Sahib.

Dismissed.
