State of Punjab and another .... Respondents CORAM: HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA
Present:

Mr. Paramjit Batta, Addl. A.G., Punjab.
***** SANJEEV PRAKASH SHARMA , J (ORAL) 1.
The petitioner by way of this petition has prayed for quashing the order dated 20.05.2021 (Annexure P-2), whereby, the petitioner's claim for compassionate appointment was rejected by the authority on the ground that wife of Balvir Singh, i.e. mother of the petitioner had already been given the benefit of compassionate appointment. 2.
Even on second call, none has put in appearance on behalf of the petitioner.
3.
The case of the petitioner is that even more than one member of the family could be given the benefit of compassionate appointment. The petitioner seeks to rely upon a judgment passed in the case of Asha Rani Vs. State of Punjab, 2015(4) SCT 250, to submit that the State should act sympathetically and should not put unreasonable restrictions on the rights of such persons. It has also submitted that other similarly situated persons were given the benefit of compassionate appointment to more than one DINESH BANSAL 2023.08.11 13:32 I attest to the accuracy of this order Chandigarh

4.
The purpose of compassionate appointment is to cover the immediate financial distress caused on account of sudden demise of an earning member of the family to whom they are dependent. Since the petitioner's mother has been offered employment, the said purpose stands served. No right is created in favour of son for compassionate appointment thereafter. The rule cannot be construed as another source of employment. 5.
Keeping in view the above, the present petition is found to be meritless and accordingly, the same is dismissed. (SANJEEV PRAKASH SHARMA) 08.08.2023 JUDGE D.Bansal Whether speaking/reasoned :
