**** RAMESHWAR SINGH MALIK J. (ORAL) Learned counsel for the parties are ad idem that allegations on the basis of which the impugned orders have been passed, removing the petitioner from the post of Sarpanch and allegations in the FIR were exactly same.

It is a matter of record that in criminal case bearing FIR No. 34 dated 24.3.2011 (Annexure P-13), petitioner has been found guilty by the learned court of competent jurisdiction and he has been convicted and sentenced. However, as per stand taken by the petitioner, his appeal against Amit Kumar 2016.08.27 15:33 I attest to the accuracy and authenticity of this document the judgment of conviction is pending.

Civil Writ Petition No. 24426 of 2014 (O&M) In view of the abovesaid fact situation obtaining in the present case, instant writ petition is disposed of with liberty to the petitioner to seek his remedy, in accordance with law, if he is acquitted by the learned appellate court, allowing his appeal against the judgment of conviction. It is also made clear that disposal of the present writ petition will not be taken as any expression on the merits of the case, at the hands of this Court. With the abovesaid observations made, writ petition stands disposed of.
