***** HARI PAL VERMA, J. (Oral) This order shall dispose of two petitions i.e. CRM-M-312702019 and CRM-M-35127-2019, as the same have arisen out of common FIR and similar facts are involved in both the cases. However, for brevity, facts are being noted from CRM-M-31270-2019.

Criminal Misc. No. M-31270 of 2019 -2Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioners in case FIR No.101 dated 02.07.2019 under Sections 406, 498A IPC (Annexure P-1) registered at Police Station Fatehgarh Sahib, District Fatehgarh Sahib.

Counsel for the petitioners submits that pursuant to order dated 24.07.2019 of this Court, the parties have appeared before the Mediation and Conciliation Centre and the matter has been compromised. As per paragraph 6 of the compromise/settlement dated 10.09.2019, apart from other conditions, the petitioner - Devinder Singh (husband) shall give an amount of Rs.6,50,000/- to the respondentAmandeep Kaur (wife) in lieu of the maintenance and in terms of the said agreement, a demand draft of Rs.1,50,000/-, in the name of Amandeep Kaur, is being handed over to counsel for the complainant in Court. Counsel for the complainant does not dispute the factum of aforesaid compromise and has accepted the demand draft of Rs.1,50,000/- with an undertaking that the respondent-complainant shall be bound by said compromise.

In view of above, since the matter has been compromised between the parties, the order dated 24.07.2019 passed in CRM-M-312702019 and order dated 28.08.2019 passed in CRM-M-35127-2019, whereby the arrest of the petitioners has been stayed, are made absolute. In case the petitioners are required in the case, in any manner, a clear 15 days notice would be given to them.

Criminal Misc. No. M-31270 of 2019 -3A photocopy of this order be placed on the file of other connected case.
