On 23.07.2024 the following order was passed : "Learned counsel for the petitioners would contend that on 21.02.2024 an application was filed for summoning of witnesses by the petitioners herein which was allowed by the concerned Court by making an endorsement on the said application that dasti summons be issued of the date fixed. Thereafter, one of the witnesses i.e the Axis Bank official mentioned at Clause B, was examined as RW2. Learned counsel would further contend that subsequently notice was also issued to the witness mentioned in Clause A on 24.04.2024. Thereafter, vide the impugned order the application for summoning the witness has been dismissed.

Notice of motion returnable 27.09.2024.

Learned counsel appearing on behalf of the respondent states that he would have no objection if the present revision petition is allowed. He, however, prays that the Court may be directed to conclude the evidence in a time-bound manner.

In view of the statement made by learned counsel for the respondent, the impugned order dated 31.05.2024 passed by the Trial Court is set aside and the application for summoning the witness stands allowed. The Trial Court shall ensure that no unnecessary dates are granted in the case and that the same is concluded expeditiously in accordance with law. 4.

Present revision petition is disposed off in the above terms. Pending applications, if any, also stand disposed off.
