Dated Police Station Sections 17.06.2023 Sidhwan Bet, 323, 341, 506, 148, 149 IPC District Ludhiana (Section 307 IPC added later on) 1.

The petitioner incarcerated in the FIR captioned above came before this Court under Section 439 CrPC, seeking regular bail. 2.

Per para 13 of the status report as well as the custody certificate dated 07.07.2025, the accused has no criminal history.

The facts and allegations are being taken from the reply filed by the State, which reads as follows:

"That the brief facts of the case are that on 17-06-2023 complainant Gurjant Singh son of Makhan Singh resident of village Parjian Kalan PS Sidhwan Bet District Ludhiana gave statement to the police that he is a labourer by profession. There was altercation between his family members with Bagga Singh @ Baggy and his brother Ajay Kumar. But this dispute was settled in the village by the respectable persons.

3. That the complainant further stated that on 11-06-2023, he and his wife Rajvir Kaur were returning from Sidhwan Bet to his village on motor cycle. At about 8:00 PM, when they reached in the area of village Parjian Kalan, petitioner Baggi son of Ramesh Singh armed with iron rod having revolving cycle part (grari), Gaggi son of Mota Singh armed with Dang,

Sony son of Kulwant Singh, Vicky son of Dati empty handed, Maani r/o Gosuwal and Kuldeep Singh @ Bittu son of Pritam Singh wrongfully restrained them. Then petitioner Baggi gave three blows of rod on his head SHARMA and forehead. Ajay Kumar gave 2 blows on his left arm. Gaggi gave sota blow on his right arm. Roky gave a dang blow on his right foot. He fell down on the ground. Soni gave kick blows on his head. Vicky, Maani and Kuldeep, Singh Bittu were abusing him and threatening him. He and his wife Rajvir Kaur raised noise. People gathered there. The accused persons ran away from the spot along with their weapons. The complainant and his wife signed his statement. On this statement FIR No. 106 dated 17-06-2023 u/s 341/323/506/148/149 IPC was registered against Bassi (petitioner), Ajay Kumar, Gaggi, Roki, Soni, Vicky, Maani and Kuldeep Singh @ Bittu in PS Sidhwan Bet." 4.

The petitioner's counsel prays for bail by imposing any stringent conditions and contends that further pre-trial incarceration would cause an irreversible injustice to the petitioner and their family.

The State's counsel opposes bail and refers to the reply. 6.

It would be appropriate to refer to the following portions of the reply, which read as follows:

"That the petitioner has caused injuries in the head of the complainant. One of these injuries was declared as dangerous to life and other head injuries were declared as grievous injuries by the doctor. So the petitioner has committed serious offence. It is apprehension that the petitioner may tamper with the prosecution evidence by putting pressure on the injured and other eye witnesses. So the petitioner does not deserve the concession of regular bail at this stage. In these circumstances, it is respectfully prayed that the present petition may kindly be dismissed." REASONING:

Allegations against the petitioner are grievous in nature. 8.

A perusal of the bail petition and the documents attached primafacie points towards the petitioner's involvement and does not make out a case for bail. The impact of crime would not justify bail. Any further discussions will likely prejudice the petitioner; this court refrains from doing so.

The petitioner's custody of around 01 year & 03 months, cannot be termed prolonged, given the minimum sentence prescribed for the offense. 10.

Any observation made hereinabove is neither an expression of opinion on the

case's merits nor shall the trial Court advert to these comments. 11.
