*** AUGUSTINE GEORGE MASIH, J. (Oral) Prayer in this writ petition is for demarcation of the land, details of which have been given in Para No.4 of the writ petition. The details of these khasra numbers and the land are reflected in the communication dated 27.05.2021 (Annexure P-2) sent by the Block Development and Panchayat Officer, Shambu Kalan to the Tehsildar Rajpura requesting for demarcation of the said land. Despite that request and the subsequent requests on behalf of the Sarpanch of the village, copies of which have been appended as Annexures P-3 and P-4 with the writ petition, no action has been taken as till date, the demarcation of the said land has not been carried out. Learned State counsel, on the instructions from Jatinder Pal Singh, Panchayat Secretary, Block Shambu Kalan, District Patiala, has submitted that there is already a direction issued by this Court in CWP No.3732 of 2021 titled as 'Balwinder Singh vs. State of Punjab and others' decided on 24.02.2021, NEETU RANI 2021.09.24 15:56 I attest to the accuracy and integrity of this document PHHC

which pertains to the same village comprising in Khewat No.92/97 Khatoni No.132, Khasra No.219 min (2-14). He further informs the Court that the demarcation is now fixed for 01.10.2021 with the Total Station Survey Machine. Learned counsel for the petitioner submits that since the demarcation is being carried out of the same area, this land be also included in the demarcation.

Request of learned counsel for the petitioner appears to be just and reasonable and therefore, a direction is issued to the respondents to carry out the demarcation of the land, details of which have been mentioned in para No.4 of the writ petition and also in the letter dated 27.05.2021 (Annexure P-2) written to the Tehsildar, Rajpura by the Block Development and Panchayat Officer, Shambu Kalan. The said demarcation be carried out on 01.10.2021. In case, it is found that there is unauthorized possession of any person, proceedings in accordance with law be initiated against the said person within a period of 40 days from the date of demarcation.
