ARUN MONGA, J. (ORAL) Petitioners herein, inter alia, seek issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to issue appointment letters to them along with all consequential benefits (notionally) for the post of Mid-level Health Providers-cum-Community Health Officers from the date when the similarly situated candidates have joined their duties. 2.
Learned counsel for the petitioners submits that the petitioners were selected in the waiting list and two posts of general category for Panchkula District and two posts for Sirsa District were kept vacant because of the pending litigation. He further submits that now the matter has been resolved and the SLP filed against the same has been dismissed. 3.
Learned counsel for the petitioners submits that qua their aforesaid grievance, petitioners submitted a representation dated 03.09.2021 (Annexure P-5), but to no avail. Hence, the instant petition. 4.
Learned State counsel, on advance service, joins proceedings and states that competent authority shall take appropriate decision on the VANDANA 2021.09.23 17:45 I attest to the accuracy and integrity of this document
pending representation dated 03.09.2021 (Annexure P-5) in accordance with the applicable rules.

At this stage, learned counsel for the petitioner also agrees that let a final decision is taken, either way, by the competent authority on the pending representation dated 03.09.2021 (Annexure P-5), giving reasons thereof.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioners as per representation dated 03.09.2021 (Annexure P-5) and also by keeping in view the contention raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of 06 weeks from today. If a favorable order is passed, benefit thereof be accorded within 30 days thereafter.

Disposed of accordingly.
