**** HARSIMRAN SINGH SETHI , J. (ORAL) By this common order, above-mentioned two Civil Writ Petitions are being disposed of in the light of common question of law and similar facts involved.

The prayer of the petitioners in the present writ petitions is for the grant of benefit of military service, which they had rendered during the 2nd National Emergency.

CWP-22802-2016 and -2CWP-22939-2016 Learned counsel for the petitioners prays that the benefit has already been granted to the petitioner in CWP No.22940 of 2016 titled as 'Sudarshan Singh Vs. State of Punjab & others', and the present petitioners are the similarly situated and therefore, they are also entitled for the said benefit.

Counsel for the petitioners prays that at this stage, the petitioners will be satisfied in case a direction is issued to the respondents to consider the case of the petitioners under the rules governing the service for the grant of benefit of the military service rendered during the 2nd National Emergency, by passing an appropriate speaking order in a time bound manner.

Learned counsel for the respondents states that case of the petitioners will be considered in accordance with law and an appropriate order will be passed within a period of three months from the date of receipt of certified copy of this order.

Learned counsel for the petitioners states that keeping in view the stand taken by learned counsel for the respondents, petitioners do not wish to press the present writ petitions any further and the same may be disposed of as having been rendered infructuous. Ordered accordingly.
