BHARDWAJ , J (ORAL) By means of instant petition, a writ of Certiorari is sought for quashing the speaking order dated 19.06.2020 vide which claim of the petitioner raised vide legal notice dated 12.02.2019 (Annexure P.6) has been rejected; with a further prayer for issuance of writ of mandamus directing the respondents to release the interest @ 8% per annum on the arrear of pay from the date arrears of pay became due till the date of its disbursement. Learned counsel for the respondent-State submits that the controversy involved in the present petition is squarely covered by the judgment dated 06.08.2024 passed by this Court in a bunch of writ petitions with CWP-161782020 (O&M) titled Ved Parkash Sharma vs. State of Haryana and Ors.' being the lead case.
Counsel for the petitioner does not dispute the same and contends that even though the L.P.A had been dismissed but the said order was challenged in SLP before Hon'ble Supreme Court of India. The SLP was withdrawn to file a review in which notice has now been issued by the Division Bench-II. It is, however, not in dispute that there is no stay on the judgment dated 06.08.2024. No purpose would be served by keeping this writ petition pending. Dismissed, in terms of order 06.08.2024 (supra).
