(Oral) The petitioner being a successful bidder in an open auction held in the year 1977, was allotted SCO No.1 in 'Gian Singh Rarewala Scheme' on link road, Ludhiana. The petitioner is said to have constructed the commercial site comprising three storeys building, a part whereof is stated to be not sanctioned but is 'compoundable'. The short grievance of the petitioner in the instant writ petition is that though he has applied for compounding the unauthorized construction and he is willing to deposit the requisite charges but no decision is taken by the Municipal Authorities. In this regard, the petitioner is said to have served the authorities with a legal notice dated 30.04.2015 (P-13) but the action thereupon is still awaited.

CWP No.23804 of 2015 [2] Having heard learned counsel for the petitioner and considering the nature of relief sought by him, however without expressing any views on merits of his claim, we dispose of this writ petition with a direction to respondent No.2 to consider and decide the claim of the petitioner in accordance with the building by-laws/Rules/Regulations within a period of three months from the date of receiving a certified copy of this order.
