On our asking, Mr.Anil Mehta, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents.

Let four copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage.

The petitioner is stated to be a resident of Maruti Kunj, Naya Gaon, Sohna Road, Gurgaon. A separate Gram Panchayat has been constituted for Naya Gaon by the State MOHINDER KUMAR 2015.11.18 12:01 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.23815 of 2015 [2] Government and pursuant thereto, the exercise of delimitation of wards and allocation of voters to different wards has also been undertaken.

The petitioner's grievance is against the 'wardbandi' as well as the inclusion/allocation of voters, namely, preparation of voter lists of each ward. He submitted objections against the same but finding no response thereto, the instant writ petition has been filed.

We find from the records that there are comprehensive objections submitted, questioning the delimitation of wards and preparation of voter lists of ward Nos.1 to 17 in respect of Gram Panchayat, Naya Gaon, Block Sohna, District Gurgaon. Since the statute obligates the authorities to consider and decide such objections, the instant writ petition is disposed of with a direction to respondent No.3-Deputy Commissioner-cum-District Election Officer, Gurgaon, to take up the matter and/or entrust the same to the authorized officer who shall then call for the records and take an appropriate decision as early as possible but well in advance before the Gram Panchayat elections are held. Ordered accordingly.
