Mr. Deshpreet Singh, Advocate, for respondent No.2. RAMENDRA JAIN, J. (ORAL) In compliance of order dated 23.01.2020, learned counsel for the petitioners has produced receipt of `20,000/-. The same is taken on record. Registry is directed to verify the deposit of costs by the petitioners with the concerned quarter.
Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.58 dated 30.04.2019 registered under Sections 452, 323, 148, 149 IPC at Police Station Kotbhai, Sri Muktsar Sahib, and all consequential proceedings arising therefrom, on the basis of compromise (Annexure P-2) arrived at between the parties. Pursuant to order dated 23.07.2019 of this Court, the parties appeared before learned Judicial Magistrate First Class, Gidderbaha, on 05.11.2019 to get their statements recorded. Learned Judicial Magistrate First Class, Gidderbaha, has submitted his report vide letter bearing No.497 RAVINDER SINGH 2020.02.14 09:41 I attest to the accuracy and integrity of this document
-2CRM-M-31222 of 2019 dated 15.11.2019, duly forwarded by learned District and Sessions Judge, Sri Muktsar Sahib, vide letter No.2286/EB dated 16.11.2019. According to the above report, compromise arrived at between the parties is genuine, voluntary and without any coercion or undue influence.
Therefore, in view of above and the fact that the compromise will bring peace and harmony between the parties, FIR No.58 dated 30.04.2019 registered under Sections 452, 323, 148, 149 IPC at Police Station Kotbhai, Sri Muktsar Sahib, and all subsequent proceedings arising therefrom, are quashed.
Disposed of accordingly.
