3. Whether the judgment should be reported in the Digest? --- Surya Kant, J. (Oral) The petitioners are residents of village Hardaspur, Tehsil and District Patiala. Their grievance is against the shifting of site for the discharge of waste water of their village from Khasra No.261 to 571. It is claimed that the existing site is the most suitable for the said common purpose and the Gram Panchayat ought not to shift the same.
In our considered view, the above-mentioned subject does not require any Judicial review in exercise of writ jurisdiction of this Court unless the same is found detrimental to the larger public interest. Suffice it would thus be to direct the District Development and Panchayat Officer, Patiala to take stock of the situation and ensure that the site for discharge of waste water of the village, if so required, be shifted keeping in view the interest of inhabitants of the village.
