HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.34 dated 07.03.2020 under Sections 399,401 IPC and Section 25 of the Arms Act registered at P.S Adampur, District Jalandhar. As per contents of FIR, a secret information was received to the effect that Pardeep Sharma @ Deepu, Gopal Singh @ Gopa besides the present petitioner out of whom Pardeep Sharma @ Deepu and Gopal Singh @ Gopa had come on parole, armed with countrymade pistol and foreign weapons in large quantity were going to Village Chuharwali from Alawalpur on a car make Figo bearing No.PB-10-DG-9656 and could commit a big crime resulting into causing physical and physical loss. Upon which, a naka was laid and the accused persons were arrested. From their possession, one 9 mm foreign pistol and 14 live cartridges of the same bore and one country-made pistol 32 bore along with 18 live cartridges of the same and one country made pistol 32 bore along with 6 live cartridges were recovered respectively.

CRM-M-35928 of 2020 #2# has falsely been involved. Alleged recovery has falsely been foisted upon the petitioner and that the petitioner has no connection with the co-accused and that the trial is not making any headway. Opposing the petition, the learned State counsel has submitted that challan in this case was presented on 06.05.2020 and the petitioner in custody since 07.03.2020.

Without commenting anything on the merits of the case and also bearing in mind the custody period, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Jaswinder Singh @ Jony is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
