Present writ petition is challenge to the impugned award dated 03.10.2017 (Annexure P6), passed by the Presiding Officer, Industrial Tribunal-cum-Labour Court-II, Gurugram (hereinafter referred to as "learned Tribunal") whereby reference was decided against the present petitioner.

In the present case, for lapses on the part of present petitioner, charge sheet was issued to him; thereafter, regular enquiry was conducted and charges against him are fraud, embezzlement and cheating as well. Due opportunity was given to the workman and the learned Tribunal has already considered all these aspects while pronouncing the award. Thus, no case is made out to set aside the impugned award dated 03.10.2017 (Annexure P6) and present petition stands dismissed.
