The matter has been taken up through video conferencing in the light of COVID-19 pandemic.

At this stage, it has been brought to the notice of this Court that in the head note of the petition, it has been mentioned that it is the first petition under Section 438 Cr.P.C. However, earlier a petition was filed under Section 438 Cr.P.C., and as such, this is second petition. As such, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to file afresh with better particulars.

In view of the submission so made, the present petition stands dismissed as withdrawn, with the liberty aforesaid.
