The grievance of the petitioner is that vide order dated 30.8.2016 passed by the State Transport Appellate Tribunal, Punjab, a direction has already been issued to permit/ regularize the time table of the petitioner transport company, within a period of three months but no action has been taken.
Through the instant petition, the petitioner seeks a direction for compliance of order dated 30.8.2016. The jurisdiction of the High Court under Article 226/227 of the Constitution of India cannot be utilized by treating the High Court as an executing Court for an order passed by the State Transport Appellate Tribunal, Punjab. However, in the interest of justice, this petition is disposed of with a direction that the grievance of the petitioner in Annexure P-4 and P-5 dated 27.10.2016 and 4.1.2017, respectively, would be considered by the Secretary, Regional Transport Authority, Ferozepur. In case the petitioner is entitled for enforcement of order dated 30.8.2016, necessary action, in accordance with law, will be taken. It will be appreciated in case the claim of the petitioner is looked into within a period of three months after receipt of a certified copy of this order, by passing a speaking order.
