RAJIV NARAIN RAINA, J.(Oral) The prayer in the present petition is for a direction to the respondents to provide employment to the petitioner who is an oustee of the Ranjit Sagar Dam Project as his ancestral lands were acquired for construction of the dam. These rights are granted by Rehabilitation and Re-settlement Scheme promulgated on 18.11.1993. Learned counsel for the petitioner submits that the petitioner's claim falls in the scheme and he deserves an appointment but his case has not been addressed nor his grievance redressed despite legal notice served on the competent authority in the Government. Having heard the learned counsel for the petitioner, this appears to be a fit case in which a direction should go to the 4th respondent to consider and decide the legal notice dated January 01, 2015 (P-9) in accordance with the terms of the scheme.

However, if for any reason, the claim is to be denied, then the petitioner would be heard and a speaking order passed. In case hearing is not required, then the legal notice be decided within 2 months from the date of receipt of a certified copy of this order. In case hearing has to be offered, that period will stand extended by 30 days.
