The instant writ petition has been filed challenging the order dated 15.05.2017, passed by the Debts Recovery Tribunal-III, Chandigarh, whereby an application moved by the petitioner for the review of order dated 08.05.2017 has been turned down. Vide the said order dated 08.05.2017, the petition filed by the petitioner was dismissed on account of delay of 93 days. There can hardly be any quarrel that the above stated order is appealable before the Debts Recovery Appellate Tribunal, New Delhi. We, thus, dispose of this writ petition with liberty to the petitioner to file an appeal before the Debts Recovery Appellate Tribunal. It is directed that in case the appeal is filed within a period of two weeks, the learned Appellate Tribunal shall condone the delay in filing the appeal for the reason that the Deepak Kumar Bhardwaj 2018.01.30 12:26 I attest to the accuracy and integrity of this document
Civil Writ Petition No. 19387 of 2017 instant writ petition was filed by the petitioner without any delay on 30.05.2017 and she has been pursuing her remedy before this Court till date.
