CM No. 7845-CI of 2009 This is an application seeking condonation of delay of 6 years, 6 months and 23 days in re-filing the appeal.
Learned counsel for respondent No. 2 does not have any objection to the condonation of delay.
Accordingly, for the reasons stated in the application and the fair stand of learned counsel for respondent No. 2, delay of 6 years, 6 months and 23 days in re-filing the appeal is condoned.
The application stands disposed of.
RFA No. 2770 of 2009 Learned counsel for the parties submitted that the issue raised in the present appeal regarding determination of compensation for the acquired land has already been gone into by this court in R.F.A. No. 3350 of 2002 -Bharat Petroleum Corporation Limited v. Harbans Kaur and others, decided on 20.7.2010, wherein award of the learned court below has been upheld. Considering the aforesaid stand of learned counsel for the parties, the present appeal is dismissed. Consequently, the accompanying applications are also dismissed.
