(Oral) Prayer is for grant of anticipatory bail in case having FIR No.13 dated 28.1.2022 registered under Sections 323, 324, 34 IPC (Sections 325, 326 IPC added later on) at Police Station Qadian District Batala. On the last date of hearing interim bail was granted to the petitioner and he was directed to join the investigation with the following observations:- GAURAV SOROT 2023.01.19 16:49 I attest to the accuracy and authenticity of this order, judgment and documents.

( 2 ) CRM-M-36471-2022 "It is a moot point as to whether the deep cut found in the right tibia of the complainant is covered under the definition of previous injury as provided under Section 320 IPC."

Today the counsel for the petitioner submits that the petitioner has joined investigation with the police in the light of previous order of interim bail passed by this Court.

State counsel on instructions from ASI Surinder Kumar has not refuted the aforesaid assertions made by counsel for the petitioner and further submits that the recovery of Datar has been effected from the petitioner and he is not required by police for further investigation or for custodial interrogation.

In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 24.8.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
