Present petition has been filed under Section 483 of the BNSS, seeking regular bail in case FIR No.42 dated 31.05.2025, under Sections 21-C, 29, 61, 85 of NDPS Act, registered at Police Station Majitha Road, Amritsar.

Case of the prosecution, in brief, is that on 31.05.2025, while a police team was on patrolling duty in search of persons with doubtful antecedents, two young persons were noticed coming on foot from Abadi Karmapura. On seeing the police party, they allegedly became perplexed and tried to flee, thereafter attempting to conceal themselves behind bushes. It is further alleged that both persons started throwing wax envelopes by taking it out from their right pocket of the pant.

Upon apprehension, they disclosed their identities as Prabhjot Singh @ Giltree and Davinder Singh @ Dev (present RASHMI 2026.05.29 19:38 I attest to the accuracy and integrity of this document

CRM-M-29762-2026 petitioner). On search and weighment, each wax envelope was found containing 504 grams of heroin along with the wax covering. Thus, a total recovery of 1 kg 8 grams of heroin is alleged from both accused. 3.

Petitioner is in custody only since 31.05.2025. Recovery effected from the petitioner is stated to be more than four times the maximum quantity prescribed for non-commercial quantity under the NDPS Act. Out of a total of 14 prosecution witnesses, none has been examined till date. Allegations against the petitioner are of a serious nature under the NDPS Act. The offence is punishable under stringent provisions of the Act, which impose strict conditions for grant of bail in terms of Section 37 thereof.

Keeping in view the gravity of the offence, quantity of contraband allegedly recovered, stage of trial, and the statutory embargo under Section 37 of the NDPS Act, this Court is of the considered view that no ground for grant of bail is made out at this stage. Accordingly, present petition is dismissed.
