Learned counsel for the petitioner would contend that the Gram Panchayat was bifurcated into Gram Panchayat, Kallar Khera (Mandi) and Gram Panchayat, Kallar Khera, however, there has been no bifurcation of assets between both the Gram Panchayats. The Sarpanch of village Kallar Khera has got a resolution passed for construction of a gate in the memory of her late husband, who had not rendered any notable service either to the nation or for that matter to the village. Learned counsel for the petitioner would further contend that the petitioner has no objection to the gate being constructed, however, the gate if it has to be named should be named after some person who atleast has rendered some service to the nation. 2.

Learned counsel for the parties, at this stage, are ad idem that both the Gram Panchayats would represent before the Deputy Commissioner, Fazilka (respondent No.4 herein) who would then take a decision with regard to the matter.

In view thereof, the present petition is disposed off with a direction that both the Gram Panchayats i.e. Gram Panchayat of village Kallar Khera (Mandi) and Gram Panchayat of village Kallar Khera would approach the Deputy Commissioner, Fazilka who would take a decision in the matter after affording an opportunity of hearing to all the parties concerned. Till such time as no decision is taken, though the construction of the gate would continue, however, no name would be put up on the gate. 6.

Disposed off. Pending applications, if any, also stand disposed off.
