The petitioner is seeking concession of anticipatory bail in case FIR No.98 dated 15.06.2023 under Sections 22/29/61/85 of NDPS Act registered at Police Station Bhawanigarh District Sangrur.

Learned counsel for the petitioner inter alia contends that the petitioner was nominated as an accused on the basis of a disclosure statement allegedly suffered by co-accused Jagga Singh from whom the recovery of 450 tablets of Tramadol and 200 tablets of Alprazolam was effected. Learned counsel submits that the evidentiary value of such disclosure statement is of a weak nature. It has been further submitted that the recovery effected does not fall within the commercial quantity and hence, the petitioner deserves the concession of anticipatory bail.

Heard learned counsel for the parties and perused the relevant material available on record.

In view of the criminal antecedents of the petitioner, prima facie, he comes across a habitual offender and thus, does not deserve the extraordinary concession of anticipatory bail. Accordingly, the present petition stands dismissed.
