(Oral) The petitioner who claims to be tenant of Booth No.37, Sector 9-D, Chandigarh, has primarily approached this Court under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Certiorari quashing the order dated 23.08.2016 (Annexure P-9), order dated 13.07.2015 (Annexure P-5) and Order dated 20.09.1983 (Annexure P-3), passed by the respondents, as the same are against the prescribed procedure of law and is in total contradiction of Chandigarh Administration Notification dated 31st March, 2006. The primary prayer of the petitioner is against the resumption of the aforesaid booth by the Chandigarh Administration.

Learned counsel for the petitioner states that inadvertently certain relevant particulars and documents could not be appended with the present writ petition. He, however, states that he may be allowed to withdraw the present writ petition with liberty to the petitioner to file a fresh petition on the same cause of action by furnishing better particulars and attaching relevant documents. 3.

Dismissed as withdrawn with liberty as prayed for. 4.

The office shall tag the present writ petition along with the fresh writ petition as and when the same is filed.
