JASWANT SINGH, J (ORAL) Prayer in this application bearing CM No.4493 of 2017 is for placing on record short reply on behalf of respondent Nos.1 & 2 besides grant of exemption from filing certified copies of R.1/1/T & R.1/2/T.

The main case is listed for hearing on 27.4.2017 wherein bailable warrants have been issued for securing the presence of the M.D, Markfed, in compliance of order dated 02.3.2017. Learned counsel for the respondents-Markfed states that two applications bearing CM Nos.4558 and 4559 of 2017 have been moved for recalling of order dated 02.3.2017 qua the presence of the M.D. Markfed and the reasons for non-appearance have been furnished in the applications.

At the time of hearing today, learned counsel for the

CWP No.23016 of 2016 (O&M) #2# respondents states that in fact, the present writ petition itself has become infructuous, in view of fresh order dated 28.3.2017 having been passed, whereby the petitioner has been restored to his original position as Officiating Branch Incharge, Rampura Phul, District Bathinda, in place of Harbans Lal, Assistant Accounts Officer-respondent No.4, in his own pay scale and that it is precisely the main relief being sought in the main petition. In view of the aforesaid stand of the respondentsMarkfed, learned counsel for the non-applicant/petitioner prays for preponement of the date of hearing and disposing of this petition as infructuous.

In these circumstances, date of hearing is preponed from 27.4.2017 to be taken up today and the writ petition bearing CWP No.23016 of 2016 itself is disposed of having become infructuous. No further orders are required to be passed in the aforesaid applications.
