(Oral) This petition has been filed in public interest seeking direction to respondents No.2 to 4 not to allow respondent No.5 (Shri Sanatan Dharam Mahavir Dal, Faridabad) to raise construction on the land in question, which according to the petitioner is in his possession, without any legal authority.

When this matter was taken up for hearing in the morning, a request was made for pass-over. Now, when this petition has been again taken up for hearing after the pass-over, Mr. Mohit Sadana, Advocate, has appeared in the Court. He requests that this matter be taken up in the after lunch session, as Shri Ravinder Singh Randhawa, Advocate, who has filed this petition on behalf of the petitioner, has to argue this matter, and he is busy before several other Benches of this Court. Though there is no justification to entertain and accept such request, particularly when the matter has been listed in the urgent list, yet in the interest of justice, let this petition be taken up in the after lunch session. CWP No. 24039 of 2015 -2After lunch session this matter was again taken up. After arguing for some time, learned counsel for the petitioner realizes that the petitioner has an alternative efficacious remedy for redressal of the dispute involved in the present writ petition, before the civil Court, states that he may be allowed to withdraw the present petition with liberty to avail the said remedy.
