(ORAL) This writ petition has been filed under Articles 226/227 of the Constitution of India inter alia for issuance of a writ in the nature of mandamus for directing the respondents to charge the rate against plot No.520, Sector 80, SAS Nagar, measuring 100 sq.yds., as prevalent at the time of acquisition from the petitioner, accordingly modify the allotment letter dated 17.03.2016 (Annexure P-6) and adjust the payment already made by the petitioner.

During the course of hearing, learned counsel for the petitioner submitted that the Contempt Court in the order dated 08.01.2015 passed in COCP No.2246 of 2014 (Annexure P-4) had made certain observations whereby the petitioner was required to fulfil and make good the prerequisites/conditions mentioned in the letter of intent dated 06.01.2015. It was also pointed out that the rate fixed by the respondents in the LOI was against the law.

-2CWP No.23081 of 2016 prayed that he may be allowed to withdraw this writ petition with liberty to the petitioner to file a review petition to seek review of the aforesaid observations.
