The petitioner-Society has approached this Court under Articles 226/227 of the Constitution of India inter alia seeking quashing the floating of tender with regard to Item No. 6 in the list of works (Annexure P-7) which already stand allotted to the petitioner without any cancellation order. 2.

On November 07, 2016, learned counsel for the petitioner submitted that the financial bid in respect of the tender in question was to be opened on 09.11.2016. On 11.11.2016, an adjournment has been sought on the similar ground. Today also, it has been stated by learned counsel that the financial bid has not been opened so far. Accordingly, learned counsel for the petitioner has made a prayer that since, the financial bid has not been opened so far, he may be allowed to withdraw the instant petition, with liberty to the petitioner to approach the Court again, if need so arises. 3.
