Seeking cancellation of anticipatory bail granted to respondent No.2 by the trial Court, the petitioner has come up before this Court under Section 483(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS].

Counsel for the petitioner seeks cancellation of bail on the ground that no recovery has been effected.

It is needless to say that bail cannot be cancelled on the ground that no recovery was effected. It is for the Investigator to ensure that entire proceeds of crime are recovered. In case, the account has not been frozen, the Investigator may do so if he think it proper. There is no need to issue notice to private respondent because it is the primary duty of the Investigator to recover proceeds of crime. 4.
Given the above Observation, counsel for the petitioner wishes to withdraw the present petition with liberty to file fresh cancellation of bail before the trial Court in case proceeds of crime are not recovered.
