On being confronted with the fact that review DPC took place after upgradation of ACR of the petitioner for the year 2006-07 still he was not found fit for the promotion and he has been subsequently promoted in the year 2011, learned counsel for the petitioner expressed his inability to controvert the same and make out his case to promote the petitioner from the year 2010.
