(ORAL) Petitioner has challenged the order, Annexure P2, dated 18.4.2013 passed by Collector (ADC), Fatehgarh Sahib, as well as order Annexure P3, dated 20.3.2014, passed by Divisional Commissioner, Patiala Division, Patiala, ordering the recovery of the stamp duty on the basis of instructions dated 28.1.2011 and 12.9.2013. The said instructions have been withdrawn by the Punjab Government vide Annexure P6, dated 3.4.2014. Without expression of any opinion on merits, it is sufficient to observe here that all the pleas raised before this Court have been brought to the notice of the competent authorities vide a legal notice dated 12.9.2013, Annexure P5.

CWP-23136-2016 (O&M) The petitioner has submitted a representation, Annexure P8, dated 9.1.2015, to the Registrar-cum-ADC-cum-Collector, Fatehgarh Sahib, requesting for recalling and reviewing the orders on the basis of order passed in CWP No.24156 of 2013 and the order of withdrawal of instructions of 28.1.2011 and 12.9.2013.

Counsel for the petitioner submits that the petitioner will be satisfied in case a direction is issued for consideration of the representation, Annexure P8, dated 9.1.2015.

This petition is disposed of with a direction to the Collector, Fatehgarh Sahib, to consider the representation Annexure P8, dated 9.1.2015, within a period of three months after the receipt of certified copy of this order in the light of subsequent instructions of the Punjab Government and the orders of the Court referred to in the representation. It will be the duty of the petitioner to communicate copy of this order to the above said authority.
