Versus

Vinay Garg ... Respondent(s)

CORAM:

HON'BLE MRS. JUSTICE ALKA SARIN

Present:

Mr. Amit Sharma, Advocate for the petitioner.

**** ALKA SARIN, J. (ORAL) Heard through video conferencing.

The limited prayer in the present revision petition is for early hearing of the ejectment petition filed by the petitioner. Learned counsel for the petitioner would contend that ejectment petition was filed by the petitioner on 21.08.2020 and along with the said petition, an application for hearing of the ejectment petition during the period of restricted hearing in view of the Covid-19 pandemic was also filed. He would further contend that despite the said application being moved by the petitioner for urgent hearing of the ejectment petition, the matter has been adjourned from time to time and now, the same has been adjourned to 11.11.2020.

Learned counsel for the petitioner would further contend that there is an urgency in the matter inasmuch as the tenant is not paying even a single penny to the petitioner-landlord for a commercial shop in YOGESH SHARMA 2020.11.04 11:39 I attest to the accuracy and integrity of this document

In view of the limited prayer being made by learned counsel for the petitioner and the fact that the ejectment application has not even been taken up for preliminary hearing by the Rent Controller, service of notice upon the respondents is dispensed with. The limited prayer of the petitioner that the matter be heard on urgent basis has not been considered by the Court below and the matter has been adjourned from time to time as is apparent from Annexures P-10 and P-11. All matters which are of urgent nature and where the application has been moved by the parties for an urgent hearing of the case, are being entertained and ought to be entertained by all the Courts below in view of the administrative orders passed from time to time by the High Court.

In view of the above, the present revision petition is disposed of with a request to the Rent Controller to hear the ejectment petition on the date already fixed i.e. 11.11.2020 or any other convenient date during the months of November-December 2020. Disposed off, accordingly.
