Mr. Ashish Rawal, Advocate for respondents No.4 & 5. **** Rajesh Bindal, J The petitioner has approached this Court impugning the order dated 28.07.2015 (Annexure P-7) vide which the application filed by the petitioner for grant of No Objection Certificate for opening of C.P.Ed., B.P.Ed. and M.P.Ed. regular courses has been rejected relying upon the letter dated 05.06.2015 issued by the State Government. The stand taken by the State Government is that they have not imposed any ban for opening new Physical Education College for running C.P.Ed., B.P.Ed. and M.P.Ed. regular courses. The University had referred to a communication dated 05.06.2015 received from the State Government, which is pertaining to B.Ed. Colleges and not for Physical Education Colleges. Keeping in view the aforesaid facts, learned counsel for University submitted that the authorities will re-examine the matter in SONIA BURA 2016.02.25 12:48 I attest to the accuracy and integrity of this document chandigarh

CWP No.24123 of 2015 -2the light of the instructions issued by National Council for Teacher Education (for short, the Council). He has further submitted that because of agitation at Rohtak, the University has been locked and no one is allowed to enter the University. He further prays for one week's time to decide the matter afresh after University become functional. After hearing learned counsel for the parties and considering the facts noticed above, the impugned order dated 28.07.2015 rejecting the application filed by the petitioner for issuance of NOC for opening of New Physical Education College for C.P.Ed., B.P.Ed. and M.P.Ed. regular courses, is set aside. The matter be considered afresh by the University in the light of the instructions issued by the Council. The needful shall be done within one week after the University opens as at present it is lying closed due to agitation in Rohtak.
