* * * * S.J. VAZIFDAR, C.J. (ORAL) It is not necessary to consider the merits of this writ petition any further. By an order dated 23.05.2017, the earlier Division Bench of this Court recorded the statement on behalf of the Haryana Urban Development Authority that the petitioner will be allotted an alternative plot as soon as he approaches the authority as he had already deposited the entire amount. The petitioner was directed to approach the Estate Officer - respondent No. 4 who was to do the needful within two weeks. The petitioner made the representations on 29.05.2017 and on 14.07.2017. In response thereto, the learned counsel appearing on behalf of respondents No. 2 to 4 has tendered a letter dated 24.07.2017 giving the petitioner three options. The petitioner has opted for an alternate plot of a similar size carved out in Sector 51/52 or any other adjoining sector. So far as the petitioner's entitlement to the plot is concerned, the matter stands resolved. The entitlement is accepted by the respondents. Needless to add that the alternate plot must be a suitable one including that it should be free from encumbrances.

The learned counsel appearing on behalf of respondents No. 2 to 4 states that Sectors 51 and 52 are developed areas and that the plot will be allotted in a developed area.

The petition is disposed of by directing the respondents to identify the plot and hand over possession thereof to the petitioner by 31.10.2017. In the event of the petitioner having any grievance regarding the plot so allotted, he is at liberty to adopt appropriate proceedings. (S.J.
