(The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) Instant petition has been filed under Article 226/227 of the Constitution of India read with Section 3(1) (a), 6 and 7 of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 ( for short, "Act") and Rule 6 of the Haryana Good Conduct Prisoners (Temporary Release) Rules, 2007, for issuance of a writ in the nature of certiorari for quashing order dated 15.09.2021 (Annexure P-1) passed by respondent No.4, whereby, prayer of the petitioner seeking extension of special parole has been rejected. CRWP-9184-2021 --2-- for another six weeks in view of fact that the petitioner is suffering with "fistula" and his health condition is not so good. The petitioner was tried in FIR No.226 dated 09.05.2013, registered under Section 302 IPC and Section 25/54/59 of the Arms Act at Police Station Civil Line, Bhiwani, District Bhiwani and accordingly, he has been convicted and sentenced for life imprisonment vide judgment and order dated 16/17.01.2015. Against the judgment of conviction and order of sentence, petitioner filed an appeal before this Court, which is still pending admitted for final adjudication. After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition. Ordered accordingly.
