At the outset, learned counsel for the petitioners states that due to typographical error, the Land Acquisition Collector, Faridkot, instead of Land Acquisition Collector-cum-SDM, Kotkapura, District Faridkot, who is the competent Authority, has been impleaded as respondent No.2 . His prayer is accepted. Registry is directed to carry out the necessary correction in the memo of parties.

Notice of motion to respondents No.1, 2 & 4 only. On our asking, Mr.Rajesh Bhardwaj, Additional AG, Punjab, accepts notice on their behalf. In view of the nature of order which we propose to pass, there is no necessity to call upon the respondents to file their reply at this stage.

The grievance of the petitioners in this case is that their land was Meenu 2016.12.16 15:19 I attest to the accuracy and authenticity of this document chandigarh

CWP-23192-2016 -2acquired for National Highway Authority of India and the compensation amount of Rs.40 lacs has been deposited by the said Authority with the Land Acquisition Collector-cum-SDM, Kotkapura (respondent No.2), but the same is not being released by respondent No.2 though the Award was passed way back on 28.10.2014.

Having regard to the categoric averments made by the petitioners, we dispose of the writ petition without expressing any views on merit with a direction to respondent No.2 to verify the facts and if it is found that the petitioners have not been paid the amount of compensation, let the same be released forthwith but not later than one month from the date of receipt of a certified copy of this order along with statutory interest upto the date of payment.

Ordered accordingly.
