IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 19647 of 2017 Date of decision: 31.08.2017 Manish Kumar ....Petitioner(s)

Versus

State of Haryana and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Madan Pal, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner seeks consideration against the post of 418 Grid Sub Station Operator advertised vide advertisement dated 20.02.2016 (Annexure P-1) on the ground that he has higher qualification and degree in Electrical Engineering. It has been averred that eligibility clause was only for diploma holders and, therefore, counsel submits that the respondents were not justified in restricting it only to diploma holders of three years in the electrical/electronic engineering candidates. He accordingly submits that on account of not having the diploma, he could not apply before the cut off date and, therefore, seeks consideration at this belated stage. It is not disputed that the cut off date was 04.04.2016 and the written examination has already been held for the same and the result has also been declared.

The stage is fixed for interview of candidates and scrutiny of documents. Once the petitioner has missed the bus and never approached this Court within time, he cannot now turn around and question the stand of the respondents fixing the essential qualifications to his detriment. It is settled principle that the law is for the vigilant and not for Shivani Gupta 2017.09.

CWP No. 19647 of 2017 those who sleep over their rights.

In such circumstances, the approach of this Court is not inclined to interfere in the matter even if interim orders have been passed in similarly situated cases. It is settled principle that the candidate has to come to the Court before cut off date and in this case, a period of 1 year and 4 months has expired since cut off date has gone by. Accordingly, the writ petition is dismissed in limine. 31.08.2017 (G.S.
